WillToRun — Terms of Service

1. Acceptance of Terms

By accessing or using the WillToRun application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

WillToRun is a terrain-aware fitness analytics platform that connects to your Strava account to analyze running activities. The Service provides terrain-adjusted performance metrics, race predictions, course visualization, and training insights.

3. Account Registration

• You must provide a valid email address and create a password to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 18 years of age to create an account.
• You agree to provide accurate and complete information during registration.

4. Strava Integration

• WillToRun accesses your Strava data through Strava's official API using read-only permissions.
• We never modify, delete, or post to your Strava account.
• You may disconnect your Strava account at any time through Account Settings.
• Your use of Strava is subject to Strava's own Terms of Service.

5. Subscription and Payments

• The Service may offer free and paid subscription tiers.
• Subscription fees, billing cycles, and cancellation terms will be communicated at the time of purchase.
• We reserve the right to change pricing with reasonable notice.

6. Acceptable Use

You agree not to: - Use the Service for any unlawful purpose. - Attempt to reverse engineer, decompile, or disassemble the Service. - Access the Service through automated means (bots, scrapers) without written permission. - Share your account credentials with others. - Upload malicious files or content. - Interfere with the operation of the Service.

7. Intellectual Property

• All content, features, and functionality of the Service are owned by WillToRun and are protected by intellectual property laws.
• The terrain classification algorithms, TerraScore methodology, TerraPace computation, and associated analytics are proprietary to WillToRun.
• You retain ownership of your personal activity data.

8. User Data and Content

• You retain all rights to the fitness data you provide or that is synced from Strava.
• By using the Service, you grant WillToRun a limited license to process your data solely for the purpose of providing the Service.
• We may use aggregated, anonymized data for product improvement and research.

9. Data Retention

• Your data is retained for as long as your account is active.
• You may request deletion of your account and associated data by contacting us.
• Upon account deletion, we will remove your personal data within 30 days, except as required by law.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WillToRun does not warrant that: - The Service will be uninterrupted, error-free, or secure. - The results obtained from the Service will be accurate or reliable. - Any defects in the Service will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILLTORUN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any errors or omissions in the Service's analytics, predictions, or recommendations.

12. Indemnification

You agree to indemnify and hold harmless WillToRun from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
